Common questions
What is a summary suit?
A suit under Order XXXVII CPC on a negotiable instrument such as a cheque or promissory note. The defendant must obtain leave to defend, which can make recovery faster than an ordinary suit.
Can I stop the other side while the case is pending?
Where there is a strong prima facie case, balance of convenience and risk of irreparable loss, the court can grant interim injunctions to preserve the position.
